Carsandpickups.com is owned and operated by Cars and Pickups, with dealership locations in Addison, Kyle and Katy, Texas. In this policy, “we”, “us” and “our” mean Carsandpickups.com, and “you” means any visitor to this website or customer of our dealerships.

This policy explains what personal information we collect, how we use and share it, how long we keep it, and the privacy rights you have under Texas law and other state privacy laws. It applies to this website and to information we collect at our dealerships in connection with a sale, service or financing transaction.

Your privacy choices

We use advertising and analytics technologies on this site that may be considered a “sale” of personal data or “targeted advertising” under Texas and other state privacy laws. You can opt out at any time in two ways:

Use the Your Privacy Choices link in the footer of any page to change your cookie and advertising preferences.
Turn on a browser or extension that sends the Global Privacy Control signal. We treat that signal as a valid opt-out request for the browser that sends it.

Opting out does not stop us from using your information for the transaction you asked us for, such as processing a credit application or servicing a vehicle you purchased.

Information we collect

The categories of personal information we collect, and typical examples, are:

Identifiers and contact information. Name, postal address, email address, telephone number.
Financial and credit information. If you apply for financing, Social Security number, date of birth, driver’s license number, employment and income information, and credit history obtained from consumer reporting agencies.
Transaction and vehicle information. Vehicles you view, purchase, trade or bring in for service, vehicle identification numbers, trade appraisal details, purchase and service records.
Commercial and preference information. Inquiries, test drive requests, financing interest, communication preferences.
Internet and device activity. IP address, browser and device type, pages and vehicle listings viewed, referring pages, dates and times of visits, and similar information collected through cookies and comparable technologies.
Approximate location. General geographic area derived from your IP address, and a more specific location only if you choose to share it with your browser’s permission.
Audio and communications. Text messages you send us, chat transcripts from the chat feature on this site, and telephone calls, which may be recorded or monitored for quality, training and lead attribution where permitted by law.
Inferences. Conclusions drawn from the above, such as the vehicle types you appear interested in.

Sensitive information

Some of what we collect to process a financing application is treated as sensitive personal data under Texas law, including Social Security number and driver’s license number. We collect this information only when you choose to apply for credit or complete a purchase that requires it, we use it only for that purpose and related legal obligations, and we do not sell it or use it for targeted advertising. If you submit a credit application, you are consenting to our collection and use of that information for the purpose of processing it. We do not knowingly collect precise geolocation, biometric data, health information, or information about race, religion, national origin, immigration status, or sexual orientation.

How we use personal information

To respond to your inquiries and requests, including test drives, trade appraisals and vehicle availability.
To process a vehicle sale, trade, financing application, warranty, shipping or service transaction.
To verify your identity and prevent fraud.
To operate, secure and improve this website.
To measure and improve our advertising, including understanding which advertisements and pages lead to inquiries.
To send you marketing communications where you have asked for them or where permitted by law. You can opt out of marketing at any time.
To comply with legal, tax, titling, registration, lending, and recordkeeping obligations.

How we share personal information

We do not exchange your personal information for money. We do share it in the following ways, and some of this sharing for advertising purposes may be considered a “sale” or “targeted advertising” under state privacy laws:

Lenders and financial institutions, when you apply for financing.
Vehicle manufacturers, warranty and service contract administrators, and insurers, as needed for products you purchase.
Service providers that operate this business on our behalf, including our website and hosting providers, our dealership management and customer relationship systems, our inventory and financing platform providers, our website chat provider, and our call and form tracking provider. These providers are permitted to use the information only to provide services to us.
Advertising and analytics partners, including Google, for website analytics and advertising measurement and targeting. This sharing happens through cookies and similar technologies and is subject to your choices described above.
Government agencies and other parties, where required to complete titling and registration, to comply with law or legal process, or to protect our rights, property or safety, or that of others.
A successor entity, in connection with a merger, acquisition or sale of all or part of our business.

We do not sell or share the personal information of consumers we know to be under 16 years of age for targeted advertising.

Cookies and tracking technologies

This site uses cookies and similar technologies that are strictly necessary for the site to function, and others that measure site usage, remember your preferences, attribute inquiries to the advertising that produced them, and support advertising. Non-essential technologies are controlled by the consent banner and by the Your Privacy Choices link in the footer, where you can see the categories in use and change your selection at any time. Blocking strictly necessary cookies is not possible because the site cannot operate without them.

Because we honor the Global Privacy Control signal, a browser that sends it will be opted out of advertising and analytics technologies automatically. We do not currently respond to the older “Do Not Track” browser setting, which has no agreed standard.

Third-party features and links

Some features on this site are provided by third parties and are hosted by them, including our online financing application and the chat feature. When you use one of these features, the information you submit is collected by that provider and handled under its own privacy policy and, where applicable, under our contract with it. This site also links to third-party sites we do not control. We are not responsible for the privacy practices of those sites.

Financial privacy notice for credit applicants

When we arrange or assist in financing, we act as a financial institution under the federal Gramm-Leach-Bliley Act. Nonpublic personal financial information collected in that process is handled under our separate Financial Privacy Notice, which is provided to you at the time you apply, and it is protected by our information security program. Information subject to the Gramm-Leach-Bliley Act is exempt from the Texas Data Privacy and Security Act, so the state rights described below may not apply to it. You can request a copy of the Financial Privacy Notice at any time using the contact details below.

Your privacy rights

Depending on where you live, you may have the right to:

Know and access the personal information we have collected about you and confirm whether we are processing it.
Correct inaccuracies in your personal information.
Delete personal information you provided or that we obtained about you.
Obtain a copy of your personal information in a portable, readily usable format.
Opt out of targeted advertising, the sale of personal data, and profiling in furtherance of decisions that produce legal or similarly significant effects.
Not be discriminated against or receive different pricing or service for exercising these rights.

How to submit a request

Email info@carsandpickups.com with the subject line “Privacy Request”, or call any of our locations at the numbers listed on our Contact page. Please tell us which right you are exercising and give us enough information to locate your records. For advertising opt-outs, the fastest route is the Your Privacy Choices link in the footer, which takes effect immediately in your browser.

We will take reasonable steps to verify your identity before acting on a request to know, correct, delete or obtain a copy of your information, and we may ask for additional information for that purpose. We do not require verification to honor an opt-out request. An authorized agent may submit a request on your behalf with written permission that we can verify.

We will respond within 45 days of receiving your request. We may extend that period once by an additional 45 days when reasonably necessary, and we will tell you before doing so.

If we decline your request

If we decline to act, we will tell you why. You may appeal that decision within a reasonable period by emailing info@carsandpickups.com with the subject line “Privacy Appeal”. We will respond in writing within 60 days of receiving the appeal and explain the reasons for our decision. If we deny the appeal, we will give you a method to contact the Texas Attorney General to submit a complaint. You may also contact the Office of the Texas Attorney General directly at texasattorneygeneral.gov.

How long we keep information

We keep personal information for as long as needed for the purpose it was collected, and then for the periods required by law. Vehicle sale, title, financing and odometer records are retained for the periods required by federal and Texas motor vehicle, tax and lending rules, which in several cases is five years or longer. Inquiry and marketing records are kept while your relationship with us is active and for a reasonable period afterward. Website analytics and advertising data is retained on the schedules set in the platforms we use, which are shorter. When information is no longer needed, we delete it or de-identify it.

Security

This website is served over an encrypted HTTPS connection, and we use administrative, technical and physical safeguards intended to protect personal information, including access controls and encryption in transit. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If you believe your information has been compromised, contact us at the address below.

Text messages and marketing

If you opt in to text messages, the terms of that program, including how to stop messages, are described in our Terms and Conditions. We do not share mobile information with third parties or affiliates for their own marketing or promotional purposes. You can unsubscribe from email marketing using the link in any marketing email, or by contacting us.

Children

This website is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us personal information, contact us and we will delete it.

Changes to this policy

We may update this policy as our practices or the law change. We will post the revised policy on this page and update the effective date at the top. Material changes will be identified in the posted policy.
